December 7, 2008 By KRISTINE SHAWKEY Standard-Examiner staff OGDEN — Several high school students are under police investigation after viewing sexually explicit material from the Internet on their cell phones during class.
Two male students at Ben Lomond High School were caught by a substitute teacher, during a shop class, accessing the Internet with their cell phones to look at nude women, said Ogden Police Lt. Scott Conley.
A third student was questioned but no inappropriate photos were found on his phone.
“We have a student or students that have violated electronic device policy for the high school to have their cell phone even on during class time,” said Donna Corby, Ogden City School District spokeswoman.
Corby referred to the Ogden City Schools Student Discipline Code of Conduct when discussing the situation. According to the code of conduct adopted by the school board on Nov. 19, the students violated a rule requiring cell phones to be turned off during class time.
Coincidentally, Nov. 19 was also the date the students were caught by the teacher.
“We have a pretty strict student discipline code about electronic devices broken out between high school, secondary school and elementary school,” Corby said.
Weber School District officials could not be reached Friday to discuss guidelines for use of electronic devices in their schools.
The school resource officer was contacted by the Ben Lomond principal on Nov. 20 to get police involved, Conley said.
The students were sent to school administrators immediately for disciplinary action and were questioned by the principal. One student denied having any pornographic material on his cell phone.
“School administrators then searched the student and found a SIM card for the cell phone hidden in his sock,” Conley said.
A SIM card is the phone’s memory card and contains records of numbers called or received or Internet sites accessed.
Administrators replaced the recovered SIM card into the cell phone and found pictures of women posed nude and in underwear.
“The juvenile was suspended from school and informed an investigation will be done, with possible criminal charges coming forth,” Conley said.
A second individual had nude photos in his phone that had been downloaded from a Web site. That student also will face disciplinary action from the school and investigation by police.
“A third student who was said to be involved was searched and had no nude photos on his phone,” Conley said.
Outlined in the code of conduct is a list of disruptive behaviors and the suggested disciplinary action to be taken.
In this case, the students had sexually explicit material in the form of pictures, which carries a maximum of nine days suspension and referral to law enforcement.
“A school resource officer has been working with school administrators to take appropriate action. Please know the student has been referred to the district office and the hearing has not taken place,” Corby said.
The case will be reviewed by detectives and attorneys, and the students may be referred to juvenile court.
